LIVINGSTON—A Columbia-Greene Community College student died as a result of injuries he suffered in a crash on State Route 9, December 31 at about 1:30 a.m.
The driver of the car in which he was a passenger has been charged with drunk driving.
An investigation by State Police revealed that a 2003 Toyota driven by Thomas Griffin, 19, of Germantown was traveling south when it went off the road and struck a utility pole near 3168 Route 9.
The rear seat passenger, Max Kelly, 21 of Germantown was extricated from the vehicle by Livingston Fire Department and treated by Northern Dutchess Paramedics prior to being airlifted to Albany Medical Center with extensive injuries, in critical condition.
Mr. Griffin was charged with driving while intoxicated and second degree vehicular assault, a class E felony. He was arraigned in Greenport Court and released on his own recognizance. Police later learned Mr. Kelly, had succumbed to his injuries. The investigation into this matter is continuing with the assistance of the Columbia County District Attorney’s Office. Further charges are anticipated.
National Grid, Verizon and Mid-Hudson Cable were requested to the scene to make repairs. Fire units were back in service at 2:48 a.m. An obituary for Mr. Kelly appears on page 16.
Stockport
David Robert Zito, 19, of Valatie was charged with failure to keep right and leaving the scene of a property damage automobile accident by Sheriff’s Sergeant William Zincio, November 29 at 3:15 p.m.
Mr. Zito was operating a 200 Saturn southbound on State Route 9, south of Crown Court when he crossed the double yellow line and sideswiped a 1999 Land Rover operated by John M. Schottler, 44, of Hudson. Deputy Louis Bray located Mr. Zito and his vehicle in a trailer park in Columbiaville. No one was injured. Mr. Zito was to answer the charges in Stockport Court at a later date.
Greenport
Jermaine Williams, 20, of Greenport was charged with second degree assault, a class D felony, by Deputies Joseph Bruno and Andrew Broockmann, December 10 at 5:28 p.m.
While an inmate of the Columbia County Jail, Mr. Williams allegedly assaulted a corrections officer. Arraigned in Greenport Court, he was sent to the county jail in lieu of $50,000 bail. He was slated to return to court at a later date.
Hudson
Brooke C. Mabb, 41, of Hudson was charged with endangering the welfare of a child by Hudson Police Officer Daniel Scali at the police station, December 3 at 7:58 p.m. After an investigation into an incident at the Hudson Junior High School, police alleged that Ms. Mabb, while working in her capacity as an aide, gave verbal permission to a juvenile student to hit another student in the face.
She was issued an appearance ticket to appear in City Court at a later date.
*Elliott L. Wynn, 39, of Catskill was charged with second degree strangulation by Hudson Police Officer Shane Bower at the police station December 11 at 3:27 a.m.
During an altercation, Mr. Wynn allegedly placed both of his hands around a woman’s neck and squeezed until she became unconscious and blacked out. Arraigned before City Judge John Connor, Mr. Wynn was sent to the Columbia County Jail in lieu of $250 cash bail or $1,000 bail bond.
*Joshua A. Mabb, 16, of Hudson was charged with endangering welfare of child and second degree harassment (physical/repeated) by Hudson Police Officer Kevin Sweet at the police station, December 13 at 6 p.m.
Joshua allegedly punched a juvenile student in the face multiple times while in the Hudson High School cafeteria in the fall. He was issued an appearance ticket following an investigation.
*Timothy Scott Hawver, 22, of Hudson was charged with resisting arrest and third degree attempted assault (with intent to cause physical injury) by Hudson Police Officer Nicolas Pierro at 938 Columbia Street, December 14 at 5:23 p.m.
Mr. Hawver allegedly punched the victim several times in the face with his fist causing swelling and pain to the victim’s face during a fight. Mr. Hawver also allegedly physically resisted being taken into custody by officers after he was told he was under arrest. He then allegedly attempted to flee back inside his house and would not give officers his hands so he could be handcuffed.
Arraigned before City Judge John Connor, Mr. Hawver was sent to the county jail in lieu of $250 cash bail or $1,000 bail bond.
*James Jennings, 25, of Livingston was taken into custody on a parole warrant by Sheriff’s Office Investigators Anthony Brahm and Mark Dunspaugh following a foot chase in the City of Hudson, December 20 at 1:18 p.m.
Investigator Brahm knew that Mr. Jennings had an outstanding state parole warrant out for him and when he saw Mr. Jennings in a vehicle he pulled it over. But after Mr. Jennings stopped the car, he got out and fled on foot. Senior Investigator William Foster, Investigator Patrick Logue and Lieutenant James Andrews along with members of the Hudson City Police Department were called in to assist with the search. Mr. Jennings was found on the roof of an apartment building on Warren Street. He was taken into custody and sent to the county jail without bail on the warrant. Additional charges are pending.
*Angel Ortiz, 26, of Hudson was charged as a fugitive from justice upon his release from the Hudson Correctional Facility by Deputy Kelly Briscoe, December 20 at 10 a.m.
Mr. Ortiz is wanted by the Berks County Sheriff’s Office in Pennsylvania. Arraigned in Hudson City Court before Judge John Connor, Jr., Mr. Oritz was sent to the county jail without bail pending extradition proceedings.
*David Riegel, Jr., 33, of Cohoes was charged with five counts of endangering the welfare of a child and third degree attempted assault (with intent to cause physical injury) by Hudson Police Sergeant Randy Clarke at the police station, December 20 at 7:25 p.m.
Mr. Riegel was involved in an altercation at a residence on the 700 block of Union Street, which police were called to investigate. He allegedly tried to assault a woman in front of children.
He was arraigned before City Judge John Connor and released.
Philmont
Derek G. Marzahl, 22, of Claverack was charged with second degree harassment and second degree obstructing governmental administration by Sheriff’s Sergeant William Zincio and Deputy Travis VanAlstyne, December 11 at 11:20 a.m.
Mr. Marzahl allegedly went to a co-workers residence in Philmont and verbally threatened her. He was arraigned in Claverack Court before Justice Michael Brandon, sent to the county jail in lieu of $1,000 cash bail or $1,500 bail bond and ordered to return to court at a later date.
Columbia County
Livingston State troopers and investigators conducted an underage drinking detail in Columbia County, December 21. During the detail, various convenience stores and local bars that sell alcohol were checked by State Police to see if they would sell alcohol to underage buyers.
Giselle J. Teegarden, 23, of Hudson was charged with first degree unlawfully dealing with a child and an Alcohol Beverage Control Law violation: selling alcohol to a minor. She allegedly sold alcohol to a person under 21 years old while at the Greenport Mobil and Subway, Fairview Avenue, Greenport.

*Melissa Johanson, 24, of Hudson was charged with failure to keep right, driving while intoxicated (operating a motor vehicle with a blood alcohol content of .08%), DWI (first offense) and aggravated DWI (having a blood alcohol content of .18% or higher by Hudson Police Officer Shane Bower at 7 South Seventh Street, Hudson, December 1 at 5:46 p.m.
Ms. Johanson was charged after police saw her driving her vehicle through a crowd of people during Winter Walk, almost striking a pedestrian. They then saw her make a right turn in the area of 7 South Seventh Street and strike a parked vehicle. She showed characteristics of intoxication and failed to satisfactorily perform field coordination tests. She was issued appearance tickets and released to third party.
